DR1: The FCC Form 470 associated with this FRN contains service provider contact information for a representative of Port-to-Port Communications. A competitive bidding violation occurs when the contact person listed on the FCC Form 470 has a connection with the selected service provider. In such cases, one bidder has access to more information than all other potential bidders. FCC rules require that all potential bidders must have access to the same information and must be treated equally in the procurement process. Applicants may not delegate responsibility for any part of the competitive bidding process to a service provider. Since the competitive bidding process was not fair and open, and therefore in violation of FCC rules, funding is denied.
