FCDL Comment:
DR1:During the course of review it has been determined that the service provider for the funding request did not offer the lowest corresponding price during the competitive bidding process and/or did not charge applicants the lowest corresponding price when creating offers/contracts. FCC rules stipulate that providers must charge eligible schools, libraries, and consortia the lowest corresponding price when providing E-rate services, and also must offer eligible entities the lowest corresponding price when submitting competitive bids to provide E-rate supported services. During the course of a review the service provider submitted documentation indicating that services were purchased by the service provider from a third party vendor and then charged the applicant for the same service a price beyond that is reasonable compared to the amount that the service provider purchased service from the third party. Accordingly, it has been determined that the service provider failed to offer its lowest corresponding price to the applicant. Since this requirement was not met, the funding request is not compliant with program rules and the request for program support is denied.||MR1:The FRN was modified from $3,700.00/month to $1,800.00/month to agree with the applicant documentation.
