FCDL Comment:
During the review process, you were asked for provide documentation related the competitive bidding process used to enter into the contract referenced in this funding request. In response, you told us that the only documentation that you retained related to that process was the bid response from Time Warner Cable Information Service, LLC and you also acknowledge that additional bids were received. You also stated that you did not retain a copy of the vendor selection documentation including the bid matrix or criteria used select the winning service provider, even though both the FCC and your local requirement mandate that these documents be retained. Because of your failure to retain these documents, USAC is unable to determine that you are in compliance with FCC , state and local procurement rules regarding the competitive bidding process, including the requirement that price of the eligible products and services was the primary factor in your bid evaluation, that you considered all bids submitted, and that you selected the most cost-effective provider, and therefore, funding is denied.
