DR1:The FCC Form 470 that established the competitive bidding process for this FRN did not include service of this type (Dark Fiber); therefore it does not meet the FCC’s competitive bidding requirement.||DR2:FCC Rules require applicants to evaluate the cost effectiveness of all bids received and to choose the most cost effective solution. Documentation provided failed to demonstrate that the selected solution Dark Fiber (No Special Construction) from Cincinnati Bell is the most cost effective option in comparison to Lit Fiber solution from Spectrum based on the vendor responses to the FCC Form 470 associated with this FRN. This FRN is denied as the applicant failed to properly evaluate the bids received and thus did not select the most cost effective solution.||MR1:The FRN was modified from CED 3/26/2022 to CED 6/30/2022 to agree with the applicant documentation.||MR2:Your FRN has been approved with the Contract Expiration Date of 6/30/2022. Although FCC Form 470, RFP and/or contract indicate you were seeking a contract with extensions, your contract does not include a definite end to the number of extensions. Program requirements do not allow for contracts with indefinite terms. Therefore, you must file a new FCC Form 470, evaluate the bids received and sign a new contract with a finite contract term for Funding Year FY 2023 and onwards for which you will seek this service.
