FCDL Comment:
FCC rules require applicants to carefully consider all bids and chose the most cost effective solution. Documentation demonstrates that the applicant did not consider all bids. During review you indicated that no bids were received for the services requested in the FRN. However, bids were provided from Earthlink and Proficient which included the services in the FRN. Since bids were received for the services requested in the FRN, an evaluation of the bids should have taken place. However, you indicated no bids were received and simply remained with your incumbent service provider without conducting a proper evaluation. Therefore, the applicant has violated the competitive bidding rules and the FRN is denied.
